The Probate Examiner can only respond to inquiries regarding the meaning of comments in the notes. No legal or procedural advice may be given by the Probate Examiner in response to your email.
- It is the goal of the Probate Examiner to have Probate Notes posted five (5) calendar days prior to the hearing.
- Defects described in the Probate Notes must be corrected prior to approval of the moving papers.
- If you are filing documents to cure technical defects, they should be filed NO LATER THAN FIVE COURT DAYS before the hearing. Later-filed documents might not be reviewed prior to the hearing and could result in a continuance of your case.
Probate Notes will be updated as needed when late-filed documents are reviewed. Please note: Late-filed documents that do not contain the hearing date in the caption require more time and effort to be matched to the files. This may result in an otherwise avoidable continuance.

• Report (page 2, lines 7-9) omits clear statement of compliance with PrC§9050 or a statement that there are no creditors known or reasonably ascertained. See PrC§9053(d). What were the results of the administrator’s “reasonable efforts”?
• Administrator reports that notice to Franchise Tax Board was not required in this matter. Notice to the FTB is mandatory in all such matters [see PrC§9202(c) and Local Rule 8.83 G].
• Report (page 3, lines 1-4) reflects that a Supplemental Inventory and Appraisal was concurrently filed. No such pleading appears to have been filed.
• Report (page 5, lines 4-8) reflects that the administrator made preliminary distributions of cash to three of the eight heirs. Did he serve a Notice of Proposed Action for these distributions? See PrC section 10520.
• Report (page 6, line 12) does not appear correct. A Request for Special Notice was filed on 02/05/24.
• Notice of Proposed Action must be filed, with affidavit of mailing attached, per Local Rules 8.83 N and 8.100.
• Schedule C-1 (Disbursements): ATM withdrawal is a method of transfer, not a payee. Does the administrator know who withdrew $160.00 from that account 9 days after the decedent passed, and why?
• Schedules I and J (proposed distributions) leave $4,684.67 undistributed. Is the administrator intending to add that amount to the reserved funds, thus reserving $19,684.67?
• Notice of Hearing file-marked 05/27/25 gave the incorrect address for this court. This court is located at 801 10th Street, Modesto. The clerk’s office is located on the Fourth floor, and this courtroom, Department 22, is located on the Sixth floor.

• Petition did not include the description of the property on hand for distribution, including the legal description and assessor’s parcel number of the real property, nor the order of specific distribution sought. See CRC 7.651, Local Rule 8.83M.
• Report did not address the status of the allowed Creditor’s Claim from the IRS. Notice of Hearing not on file for creditor (Probate Code §§ 48, 9250, 11640, 11429; California Rule of Court 7.401).

Material defects with the pleading:The report includes an allegation that the estate is insolvent, however the sole asset of the estate was a piece of real property, which the personal representative alleged she had already transferred to herself (without the court’s prior authorization). Did the personal representative pay the creditor’s claim to the U.S. Internal Revenue Service? If not, the court’s recourse may be to order the personal representative to transfer the property back to the estate, order the property sold, and order the personal representative to use the sale proceeds to pay the Creditor’s Claim.

• Paragraph 9 contains an allegation purs. to PrC§1064(a)(5) that the administrator maintained all cash invested in interest bearing accounts or other investments authorized by law except for such amounts necessary to administer the estate. The accounting reflects that the estate received no interest during the account, and the property on hand is held in a “client trust account”. Is that the attorney’s client trust account? Deposit in such account does not appear to comply with the relevant statute. Issue will be submitted to the court for determination once other notes are cured.
• The successor PR is seeking 100% of the statutory compensation payable in this matter; the petition does not appear to request apportionment to the estate of the late administrator. See CRC 7.704(a)-(b).
• There is no request for reimbursement of administrative costs. Who paid them? The estate had no liquidity until the real property was sold in January 2025 and the costs in Schedule C occurred before that. Are the costs not a liability of the estate?
o Included in the costs is the fee for publication of the petition for appointment of the successor administrator. Statute does not require published notice of that petition, and it would be for the court to determine if that cost were reimbursable.

Since there are four court departments in the same building, it does not appear that petitioner can show substantial compliance with Probate Code sections 8100, 8120 et seq.
